1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the website futrec.in (the "Site") and any consultation, business advisory, or IT development services offered by Futrec Business and IT Solutions, trading as "Futrec" (collectively, the "Services").

By accessing the Site, booking a consultation, or engaging Futrec's Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or Services.

2. About Futrec

Futrec Business and IT Solutions is a business and IT solutions company based in Andhra Pradesh, India, offering the following services:

  1. Business Model Generation
  2. Market Analysis
  3. Competitor Analysis
  4. Website Design & Development
  5. Mobile App Design & Development
  6. Digital Marketing / Lead Generation

Our Services are currently offered to startups, small businesses, enterprises, and individuals located within India.

3. Eligibility

The Site and Services are intended for use by individuals who are 18 years of age or older, or who are engaging Futrec on behalf of a legally registered business entity with the authority to do so. By using the Site or Services, you represent that you meet this requirement.

4. No Account Creation

The Site does not currently require you to create an account. Engagement with Futrec occurs through our consultation booking flow (via Zoho Bookings) and direct communication (email, calls, etc.). Futrec reserves the right to introduce account-based features in the future, at which point these Terms will be updated accordingly.

5. Booking Consultations and Engaging Services

  • Consultations may be booked through our Zoho Bookings integration accessible via the "Consult" button on the Site.
  • By booking a consultation, you agree to provide accurate and complete information (name, email, phone number, and any other details requested).
  • Where a consultation or service requires payment, such payment is processed through Razorpay, a third-party payment processor. Futrec does not directly store your full payment card or banking details.
  • Engagement for any specific project beyond an initial consultation may be subject to a separate agreement, proposal, or statement of work between you and Futrec, which will govern the specific scope, deliverables, timeline, and fees for that engagement. In the event of any conflict between these Terms and a signed project agreement, the project agreement shall prevail with respect to that specific engagement.

6. Fees, Payment, and Refunds/Cancellations

  • Futrec's Services, where paid, are billed on a one-time payment basis. Futrec does not currently offer subscription or recurring billing plans through the Site.
  • All fees are payable in advance or as otherwise agreed at the time of booking or engagement, and are processed via Razorpay.
  • Cancellation: If you need to cancel or reschedule a paid consultation, please do so at least 24 hours in advance where possible. Cancellations made within this window may be eligible for rescheduling at Futrec's discretion.
  • Refunds: Fees for consultations or services are generally non-refundable once a session has been confirmed and/or completed, except: (a) at Futrec's sole discretion, (b) where required by applicable Indian consumer protection law, or (c) as otherwise expressly agreed in writing for a specific project engagement.
  • For larger project engagements governed by a separate agreement, refund and cancellation terms specific to that engagement will be set out in that agreement.

7. Intellectual Property

7.1 Futrec's Own IP

All content on the Site, including but not limited to the Futrec name, logo, branding, text, graphics, design, and underlying code, is the property of Futrec Business and IT Solutions or its licensors, and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Site without our prior written consent.

7.2 Client Project Deliverables

For custom deliverables created by Futrec for a specific client under a paid engagement (e.g., a website, mobile app, business model document, or marketing materials developed specifically for that client):

  • Intellectual property rights in the final deliverables shall transfer to the client upon full and final payment for the applicable project or service, unless otherwise agreed in writing in a separate project agreement.
  • Prior to full payment, all work product remains the property of Futrec.
  • Futrec may retain the right to use non-confidential, general knowledge, tools, templates, and pre-existing IP developed independently of the client engagement, and may reference completed projects in its portfolio unless the client requests confidentiality in writing.

8. Acceptable Use

When using the Site or engaging our Services, you agree that you will not:

  1. Use the Site or Services for any unlawful purpose or in violation of any applicable law or regulation;
  2. Attempt to gain unauthorized access to the Site, our systems, or any related networks;
  3. Interfere with or disrupt the operation of the Site, including through hacking, scraping, or introducing malicious code;
  4. Misrepresent your identity or provide false information when booking a consultation;
  5. Infringe upon the intellectual property rights of Futrec or any third party; or
  6. Use any content, branding, or materials from the Site without authorization.

Futrec reserves the right to refuse service, terminate engagements, or restrict access to the Site for any person who violates these Terms.

9. No Guarantee of Results (Business & Marketing Services)

You acknowledge and agree that services such as Business Model Generation, Market Analysis, Competitor Analysis, and Digital Marketing/Lead Generation involve professional advice, strategy, and recommendations based on information available at the time of engagement. Futrec does not guarantee any specific business outcome, including but not limited to increased revenue, market success, lead volume, investment, or funding, as these outcomes depend on numerous factors outside Futrec's control. 10. Third-Party Services

The Site and Services rely on certain third-party tools, currently including Zoho Bookings (for scheduling) and Razorpay (for payment processing). Futrec is not responsible for the availability, performance, security, or practices of these third-party services, which are governed by their own respective terms of service and privacy policies. We encourage you to review those terms before use.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

  1. Futrec's total aggregate liability arising out of or relating to your use of the Site or Services, whether in contract, tort, or otherwise, shall not exceed the total fees actually paid by you to Futrec for the specific service giving rise to the claim.
  2. Futrec shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, business opportunity, or goodwill, arising out of or in connection with the Site or Services, even if advised of the possibility of such damages.
  3. Nothing in these Terms shall exclude or limit liability that cannot be excluded or limited under applicable Indian law.

12. Indemnification

You agree to indemnify and hold harmless Futrec Business and IT Solutions, its owners, employees, and representatives from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any applicable law; or (c) your misuse of the Site or Services.

13. Disclaimer of Warranties

The Site and Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement, except as expressly required by applicable law. Futrec does not warrant that the Site will be uninterrupted, error-free, or completely secure.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to applicable law, any disputes arising out of or in connection with these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts located in Andhra Pradesh, India.

15. Changes to These Terms

Futrec reserves the right to modify or update these Terms at any time. Material changes will be reflected by updating the "Last Updated" date at the top of this document. Continued use of the Site or Services after changes are posted constitutes acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
